Terms & Conditions of Koled Logistics

Article 1: Transport Liability

The most important thing to know about the cookies we place is that they are used to improve the user-friendliness of our website, for example by remembering the site preferences and language settings.
Article 2: Automatic Package Insurance
All shipments are automatically covered with insurance for 20% of the declared value, subject to supporting documents provided by the client. Clients may also purchase additional insurance to cover up to 100% of the declared value. Without this extra coverage, KOLED is not liable beyond the basic coverage.
Article 3: Prohibited and Restricted Packages
KOLED LOGISTICS does not accept prohibited or dangerous items, including but not limited to explosives, toxic substances, and illegal objects. The client assumes full legal responsibility in case of any violation.
Article 4: Package Packing and Preparation
It is the client’s responsibility to ensure adequate packaging of shipments. KOLED LOGISTICS is not liable for damage due to improper packaging. We reserve the right to refuse or repackage any improperly packed items at the client’s expense.
Article 5: Recipient Information
The client must provide accurate and complete information about the recipient. KOLED LOGISTICS is not responsible for delivery delays or errors due to incorrect information supplied by the client.
Article 6: Fees and Rates
Service fees for transportation are those in effect at the time of shipment. Additional charges may apply for optional services, such as additional insurance or repackaging.
Article 7: Package Tracking
KOLED LOGISTICS offers an online tracking service that allows clients to check the status of their shipments. However, we do not guarantee real-time updates on tracking information.
Article 8: Delivery Times
Delivery times provided by KOLED LOGISTICS are estimates. We cannot guarantee delivery times due to various factors, such as weather conditions or customs delays.
Article 9: Liability in Case of Delay
KOLED LOGISTICS is not liable for delays due to circumstances beyond our control, such as extreme weather events or strikes. Claims for delays will only be accepted in cases of proven negligence on our part.
Article 10: Force Majeure
KOLED LOGISTICS will not be held responsible for unfulfilled obligations due to events of force majeure, including wars, natural disasters, or other unforeseeable events.
Article 11: Lost or Damaged Packages
In the event of loss or damage to a package, the client must file a claim within 10 business days from the scheduled delivery date. Claims submitted late or without proper documentation will not be accepted.
Article 12: Right to Refuse
KOLED LOGISTICS reserves the right to refuse any package that does not comply with our terms or presents a security risk. Refused packages will be returned to the client at their expense.
Article 13: Customs and International Regulations
All international shipments must comply with the customs regulations of the respective countries. The client is responsible for ensuring compliance with these regulations and any customs fees incurred.
Article 14: Compensation
In the event of loss or damage, compensation will not exceed the declared value of the package unless additional insurance has been purchased. The client must provide all necessary documentation to process their claim.
Article 15: Modification of Terms
KOLED LOGISTICS reserves the right to modify these terms and conditions at any time. Changes will be posted on our website and will apply to future shipments.
Article 16: Limitation of Liability
KOLED LOGISTICS is not liable for indirect losses, such as loss of revenue, clientele, or any other economic harm related to the loss or damage of a package.
Article 17: Governing Law
These terms and conditions are governed by the laws of the country in which KOLED LOGISTICS is registered. Any dispute will be submitted to the jurisdiction of the competent courts in this jurisdiction.
Article 18: Data Privacy
The client’s personal information will be processed in accordance with our privacy policy. KOLED LOGISTICS is committed to protecting personal data and will not disclose it to third parties without the client’s explicit consent.
Article 19: Customer Relations
We are committed to maintaining transparent communication with our clients. Claims and inquiries will be handled promptly and efficiently.
Article 20: Service Guarantees
KOLED LOGISTICS guarantees that all services will be performed in line with industry standards. However, we do not guarantee delivery results, as they may be impacted by external factors.
Article 21: Payment Terms
All payments for KOLED LOGISTICS must be made prior to shipment processing. Late payments may incur additional charges.
Article 22: Additional Services
KOLED LOGISTICS may offer additional services, such as storage, packaging, or express transportation. Terms for these services will be defined upon request.
Article 23: Returns
Returns will be conducted at the client’s request, though return fees may apply. Returns must be requested within a reasonable timeframe.
Article 24: Client Responsibility
The client is responsible for any breach of the terms and conditions and any resulting legal consequences. KOLED LOGISTICS reserves the right to pursue action in cases of fraud or abuse.
Article 25: Responsibility of Agents and Subcontractors
KOLED LOGISTICS may use agents or subcontractors to perform services. KOLED’s liability does not extend to acts or omissions of these agents or subcontractors.

Article 27: Interpretation of Terms

Article 29: Assignment of Rights
KOLED LOGISTICS reserves the right to assign its rights and obligations to any third party without prior notice to the client. The client may not assign their rights or obligations without written consent from KOLED.
Article 30: Non-Waiver Clause
Failure by KOLED LOGISTICS to exercise a right or enforce a provision does not constitute a waiver of that right or provision. All rights and remedies remain effective.
